In these Terms of Sale/Terms of Use, the defined terms have the following meaning: “Company” means Startmining S.A.S.; “Client” means any individual or legal entity that has subscribed to a service; “ASIC” means any cryptocurrency mining equipment based on specialized integrated circuits; “Hosting” means the hosting and maintenance of ASICs in the Company's mining farms; “START Token” means the utility digital token issued by the Company.
These Terms govern the contractual relationship between the Company and its Clients for the provision of hosting services, the sale of ASICs, and access to the START platform. Any order entails full and unreserved acceptance of the Terms in force on its date.
Prices are stated in euros or dollars, inclusive of tax, depending on the service. Payment is made by bank transfer, payment card or cryptocurrency according to the options offered at the time of order. The client may be required to pay a deposit at the time of order; the balance is due according to the schedule specified in the quote or invoice.
The Client undertakes to provide accurate information upon subscription, to comply with payment deadlines, to abide by the laws in force in their country of residence regarding the holding and use of cryptocurrencies, and to inform the Company of any change of contact details or wallet.
The Company provides hosting, preventive maintenance and 24/7 monitoring of the Client's ASICs in its mining farms. The energy rate is contractually fixed for the duration of the contract. The Company guarantees a target uptime specified per site (typically 95% to 99.5%+).
Routine maintenance (cleaning, restart, monitoring) is included in the hosting service. Heavy repairs (hashboard replacement, component soldering) may be subject to a separate quote depending on the site and the type of failure.
The personal data collected is used exclusively to perform the contract and to send commercial information if you have consented to it. In accordance with the GDPR, you have the right to access, rectify and delete your data. For any request: support@startmining.io.
All content on the site, the START platform and the technical documentation remains the exclusive property of Startmining S.A.S. Any reproduction, representation or distribution without prior written authorization is prohibited.
The Company cannot be held liable for financial losses resulting from cryptocurrency volatility, changes in network difficulty, or any case of force majeure. The Company's liability is limited to the amount actually paid by the Client for the service concerned.
The Client may terminate their hosting contract subject to a notice period specified in the contract. The Company reserves the right to terminate automatically in the event of a serious breach by the Client of their obligations (non-payment, fraud, unlawful use).
These Terms of Sale/Terms of Use are governed by French law. In the event of a dispute, the parties shall endeavor to find an amicable solution. Failing that, the competent courts shall be those of the jurisdiction of the Company's registered office, unless mandatory provisions state otherwise.
